TERMS & CONDITIONS

1. General

1.1 movisi® is in the following defined as "movisi®/movisi/movisi.com/we/our/us". As a user of this web site (defined as "customer/you/your") you acknowledge that your use of this web site and/or any transactions you make are subject to our terms and conditions below, which are also deemed to include the following hyper linked information Our Policies, Intellectual Property and Delivery.

1.2 We reserve the right to change and amend these terms and conditions. Any changes we make will be deemed to have come into effect on the date that they have been posted on this web site. You are responsible for reading the terms and conditions. When you place an order with movisi® you will be deemed to have read, understood and accepted these terms and conditions. This does not affect your statutory rights as a consumer.

2. The Order Process and Our Contract

2.1 When you make an order on this web site your order will be subject to acceptance in accordance with these Terms and Conditions.

2.2 When your order has been received you will receive an order confirmation e-mail.

2.3 A contract between you and movisi® for the sale of our products will only exist once your order has been acknowledged, processed and despatched.

3. Price & Payment

3.1 The price payable for the items you order is that set out on our web site at the time you place your order.

3.2 The prices of the items that we display on our web site are subject to change without notice.

3.3 All prices, where appropriate, are inclusive of Value Added Tax (VAT) at the current applicable rate.

4. Return Policy

4.1 Our 30-day returns guarantee
At movisi® we want you to be delighted every time you shop with us. Occasionally though, you may want to return items. That's why under our 30-day returns guarantee, if for any reason you are unhappy with your purchase, you can return it to us in its original and unused condition within 30 days of the date you received the item(s).

4.2 If you are returning an item because of an error on our part or, in accordance with our returns policy, because it is damaged or defective, we will pay the delivery charges incurred in sending the item to you and pay your costs of returning it to us. We will pay the costs for return transport delivery to movisi® of the defective, damaged or incorrect items only if the transport is arranged by movisi® directly (we will arrange with you and our express courier service to collect the item(s) from your home and organise for a replacement to be sent, again subject to inspection at our warehouse). To arrange collection send an email to return@movisi.com or arrange a call-back-service with us.

4.3 When returning items that are NOT incorrect, damaged or defective items, you will be required to arrange and pay for transit. If you prefer we will arrange for a carrier to collect the items from you, however the cost of this will be charged to you and may be deducted from any refund to you.

4.4 When returning items please ensure that they are returned in their original condition and package, to ensure that no damage occurs during transit. We will be unable to accept the full amount of a refund if damage has occurred during transit. Please also ensure that you obtain proof of posting. We cannot accept responsibility for items lost in transit, unless return delivery is organised by us. For more information, please see ou Return and Refunds Policy.

When you return the items please return them to the following address together with the original “Return Form” (Download  PDF) and a copy of the invoice you received with your items:

4.6 When you send your item back to us, we will process the returned item. You can expect a refund in the same form of payment originally used for purchase within 30 days of our receiving your return.

4.7 Our Refunds Policy

a) Refund of ITEM(s): According to our Return Policy, we will issue a full refund for the price you paid for the item/s.

b) Refund od DELIVERY costs: Please note that you will be responsible for the costs of returning the items to us unless we delivered an incorrect item (if we sent you an item you did not order) or if the item is damaged (upon delivery) or defective (default on material). In case of incorrect, damaged or defective item(s), movisi® will pay the return delivery costs only if you arrange collection of the items directly with movisi® via our “please call me back” service. 5. Delivery

5.1 We make every effort to deliver the items within the expected timetable; however delays are sometimes inevitable due to unforeseen circumstances. movisi® accepts no liability in respect of any failure to deliver the items within the expected timescale. 6. Intellectual Property, Design and Reproduction

6.1 You acknowledge and agree that all copyright, trademarks and intellectual property rights in all materials (including pictures, designs, logos, photographs, text written and other materials) and the contents of these pages and in respect of any products that you purchase shall remain at all times in the ownership of movisi® or in our licensors.

6.2 You acknowledge and agree that the material and content contained on this web site is available for your non-commercial use with the sole purpose of assisting you to gain information in order to place an order with movisi®. You further agree that the modification, distribution reproduction or incorporation into any other work of part or all of the material available on this web site in any form is strictly prohibited.

7. Limitation of Liability and Warranty

7.1 The customer agrees that use of the service is entirely at customer's own risk. Services are provided 'as is,' without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with the service. Specifically, we disclaim any and all warranties, including without limitation:
a) any warranties concerning the availability, accuracy or content of information, products or services
b) any warranties of title or warranties of merchantability or fitness for a particular purpose
c) any warranties concerning responsibility for damage caused by anything or anyone that does not follow the correct use of the product.

7.2 We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the items.

7.3 This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, theft or destruction or unauthorized access to, alteration of product, tortuous behaviour, negligence, or under any other cause of action. Customer specifically acknowledges the service is not liable for the defamatory, offensive or illegal conduct of other customers or third-parties and that the risk of injury from the foregoing rests entirely with customer.

8. Miscellaneous

8.1 These terms and conditions and the use of our web site shall be governed by English law and you agree to submit to the exclusive jurisdiction of the English court.

8.2 We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to items supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

8.3 If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected.
